James Comey is under fire once again for his general ineptitude as director of the FBI.
Senator Cruz demanded that Comey explain why he decided not to prosecute Hillary Clinton’s aid, Huma Abedin. “You described the reason why the case was closed against Ms. Abedin as that you could not determine she was aware her conduct was unlawful,” prompted Cruz. “Ignorance of the law is no excuse.”
The exchanged occurred in a recent Senate Judiciary Committee oversight hearing.
Senator Cruz expressed the deep frustration that all of us are feeling — that Hillary Clinton and her friends are above the law.
The FBI decided not to prosecute Hillary Clinton for possessing a private email server that was used to communicate official government business and was discovered to contain classified information.
The decision not to prosecute was justified, because the FBI could not prove that Clinton intended to violate the law when she violated State Department rules.
After dropping the case, the FBI discovered thousands of emails from the Clinton server on the computer of Huma Abedin’s husband, Anthony Weiner, when he was being investigated for sexual misconduct involving minors.
Huma Abedin forwarded the classified emails to her husband, despite the fact that he lacked security clearances. She sent the emails to his personal and unsecured computer so he could print them out. However, James Comey applied the same standard he did with Clinton, claiming a lack of intent, and refused to prosecute.
However, as Ted Cruz rightly points out, there is absolutely no standard for intent in the relevant statute. Essentially, James Comey invented a standard purely to prevent Hillary Clinton and friends from being held accountable.
Even if intent could not be proven, it should be up to a judge to determine if the law was violated, not Director Comey.
Huma Abedin knew exactly what she was doing, and got away with it because the Washington establishment protects their own. Well, we’re not standing for it!
